1.Acceptance of Terms

By accessing r26.ca, submitting a booking request, making a payment, or using any service provided by R26 Studio Inc., you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree with any part of these Terms, you must not use this website or book any services.

2.About R26 Studio

R26 Studio Inc. is a provincially incorporated company registered in Ontario, Canada, specializing in professional visual media services for the real estate industry, serving agents and property owners throughout the Niagara Region.

R26 Studio Inc. operates in compliance with applicable Ontario and federal Canadian laws, including Transport Canada RPAS regulations governing drone operations.

3.Services Description

R26 Studio Inc. offers the following professional visual media services:

• –Photography — Professional interior and exterior property photography
• –2D Floor Plans — Accurate, professionally drafted floor plan diagrams
• –Video Tours — Cinematic walkthrough video productions
• –Drone Aerials — Certified aerial photography and videography (Transport Canada RPAS)
• –3D Virtual Tours — Interactive immersive property experiences
• –Property Listing Websites — Dedicated single-property web pages

R26 Studio Inc. reserves the right to modify, update, or discontinue any service offering at any time with reasonable notice. Specific deliverables are confirmed at the time of booking.

4.Booking & Payment

4.1How to Book

Bookings may be made through r26.ca, by email at hello@r26.ca, or by phone at (437) 453-2258. All bookings are subject to availability. By submitting a booking request, the client represents that all information provided is accurate, including property address, contact details, and service requirements.

4.2Payment Policy

Payment is accepted by credit card only. R26 Studio Inc. does not accept cash, cheque, e-transfer, or any other payment method unless otherwise expressly agreed in writing. Payment processing is handled through secure third-party providers. R26 Studio Inc. does not store full credit card information on its servers.

4.3Pricing & Taxes

All prices are exclusive of HST. Harmonized Sales Tax at 13% will be added to all invoices in accordance with the Excise Tax Act (Canada) and Ontario provincial requirements. R26 Studio Inc. is a registered HST registrant.

5.Cancellation & Refund Policy

5.1Cancellations by Client

All cancellation requests must be submitted in writing to hello@r26.ca. Cancellation time is calculated from the exact scheduled session start time.

Cancellations communicated by any means other than email (phone, text, social media) will not be recognized for refund calculation purposes unless confirmed in writing by R26 Studio Inc. Refunds are processed to the original payment method within 5–10 business days.

5.2Cancellations by R26 Studio

If R26 Studio Inc. must cancel for any reason — adverse weather, emergency, equipment failure, or NOTAM-based airspace restrictions — the client will be notified with as much advance notice as possible and will receive their choice of:

• –Full refund of the total amount paid (including HST), processed within 5–10 business days
• –Reschedule at no additional cost, to a mutually agreed date and time subject to availability

5.3Payment Processing Fee on Refunds

When a client requests a refund — whether full or partial — the client is responsible for bearing the payment processing fee charged by the payment network. This fee amounts to 2.9% + $0.30 CAD of the original transaction amount and will be deducted from the refunded amount prior to processing.

This policy applies to all refunds regardless of the reason for cancellation, including cancellations by R26 Studio Inc. under Section 5.2, except in cases where R26 Studio Inc. is found to be solely at fault due to gross negligence.

6.Rescheduling Policy

Rescheduling requests must be submitted to hello@r26.ca with reasonable advance notice. Requests made more than 48 hours before the session will be accommodated at no charge, subject to availability.

If you reschedule with less than 48 hours notice, the cancellation terms in Section 5.1 apply, and a portion of your payment is forfeited based on how much notice you gave. The refundable portion can be returned to you, or — if you prefer — kept as a credit toward the rescheduled session. If you choose credit, you pay only the remaining balance to confirm the new date.

Each session may be rescheduled a maximum of two (2) times without additional administrative fees (subject to the above notice requirements). Subsequent rescheduling requests may incur an administrative fee, communicated in advance.

7.Delivery of Work

7.1Delivery Timelines

The following guaranteed delivery timelines apply in business days (Monday to Friday, excluding Ontario statutory holidays) from the date of the session:

During peak demand, R26 Studio Inc. will notify clients if timelines may be extended. R26 Studio Inc. is not responsible for delays caused by force majeure events or third-party platform failures.

7.2Delivery Methods

Completed work will be delivered through one of the following methods, at the client's choice:

• –Private online gallery — Password-protected gallery with secure access link hosted through r26.ca
• –Cloud storage link — Shared folder via Google Drive or Dropbox, sent to the client's registered email

7.3File Retention

Any request for re-delivery after the 30-day period may be accommodated at R26 Studio Inc.'s sole discretion and may be subject to an additional fee.

8.Intellectual Property & License

8.1Ownership

R26 Studio Inc. retains full copyright and all intellectual property rights in all photographs, videos, floor plans, virtual tours, websites, and any other content produced in connection with its services. Copyright vests in R26 Studio Inc. immediately upon creation and is protected under the Copyright Act (Canada).

8.2License Granted to Client

Upon receipt of full payment, R26 Studio Inc. grants the client a non-exclusive, non-transferable, limited license to use the content solely for:

• –Marketing and promotion of the specific property that was the subject of the contracted session
• –Listing the property on MLS, Realtor.ca, and other recognized real estate platforms
• –Use in the agent's personal marketing materials in direct connection with that specific property
• –Sharing on the agent's social media accounts in connection with that specific property

8.3Restrictions

The client expressly agrees the license granted does not include the right to:

• –Resell, sublicense, assign, or transfer any content or rights therein to any third party
• –Transfer the license to another agent, brokerage, or company
• –Use content for any property other than the specific contracted property
• –Alter, crop, or modify content in a manner that damages R26 Studio Inc.'s reputation
• –Remove or obscure any watermarks, credits, or copyright notices
• –Use content for stock photography libraries, AI training datasets, or any unpermitted purpose

Unauthorized use constitutes a material breach and may result in legal action under the Copyright Act (Canada).

9.Portfolio & Marketing Rights

R26 Studio Inc. retains an irrevocable, perpetual, royalty-free right to use any produced content for its own portfolio, website, social media, promotional materials, and advertising — without requiring additional permission or compensation.

If a client wishes to request that a specific property's content not be used in R26 Studio Inc.'s marketing, they may submit a written request to hello@r26.ca. R26 Studio Inc. will honor such requests within 30 calendar days of receipt. This does not retroactively affect prior uses.

10.Property Access & Drone Operations

10.1Property Access

The client guarantees full, safe, and unobstructed access to the property at the exact date and time confirmed in the booking. If access is unavailable at the confirmed session time for any reason attributable to the client — including lockbox issues, tenant refusal, or scheduling conflicts — the session will be treated as a less-than-12-hour cancellation, and the 0% refund policy under Section 5.1 will apply automatically.

10.2Property Preparation

The client is fully responsible for ensuring the property is clean, tidy, decluttered, and presentation-ready at the scheduled session start time. All lights must be functioning and all spaces accessible. Re-shoots requested due to inadequate preparation may be subject to a full re-booking fee.

10.3Drone Operations

R26 Studio Inc. operates under valid Transport Canada RPAS certification and complies with all applicable Canadian Aviation Regulations (CARs) Part IX. By booking drone services, the client warrants that all necessary permissions from the property owner or manager for aerial operations have been obtained.

R26 Studio Inc. reserves the right to cancel or postpone drone operations at its sole discretion if any of the following are present: active NOTAM or airspace restrictions, controlled airspace, adverse weather (high winds, precipitation, fog, poor visibility), or any unsafe or unlawful flight conditions. Priority rescheduling at no additional cost will be offered.

11.Satisfaction & Revisions

No refunds will be issued based solely on aesthetic preferences or subjective dissatisfaction with creative decisions made within industry-standard professional practice.

If delivered content contains documentable technical errors — incorrect exposure, unrequested editing elements, inaccurate floor plan measurements, or material deviations from agreed scope — R26 Studio Inc. will provide re-editing at no cost.

Each situation involving dissatisfaction will be evaluated individually with the genuine goal of reaching a fair and reasonable resolution for both parties.

12.Limitation of Liability

To the fullest extent permitted by applicable law, R26 Studio Inc.'s total maximum liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim. R26 Studio Inc. shall not be liable for:

• –Indirect, incidental, special, punitive, or consequential damages of any kind
• –Loss of income, commissions, or revenue by the agent or any affiliated party
• –Lost property sale opportunities, failed transactions, or deal collapses
• –Delays in the property listing or sale process
• –Data loss from the client's failure to download files within the 30-day retention window
• –Any loss arising from third-party platform failures (MLS, Realtor.ca, Google Drive, etc.)

Nothing in these Terms limits R26 Studio Inc.'s liability for death or personal injury caused by gross negligence, or for fraud or fraudulent misrepresentation.

13.Indemnification

The client agrees to indemnify, defend, and hold harmless R26 Studio Inc., its directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including legal fees) arising out of:

• –The client's breach of any representation, warranty, or obligation under these Terms
• –Unauthorized use of content outside the scope of the license granted in Section 8.2
• –The client's failure to obtain necessary permissions for property access or drone operations
• –Any claim by a property owner, tenant, or third party arising from the client's actions
• –Any violation by the client of any applicable law or third-party right

14.Website Use

14.1General Use

r26.ca is provided for informational and transactional purposes only. Users must not use the website for any unlawful purpose or in any manner that could damage, disable, or impair the website. R26 Studio Inc. makes no warranty that the website will be available at all times or free of errors.

14.2Cookies

The website may use cookies to enhance user experience, analyze traffic, and support functionality. By using the website, you consent to the use of cookies. Users may manage preferences through their browser settings. R26 Studio Inc. does not sell cookie or user data to third parties.

14.3Third-Party Links

The website may contain links to third-party websites (Google Drive, Dropbox, Realtor.ca, etc.) provided for convenience only. R26 Studio Inc. has no control over third-party content or practices and accepts no responsibility for them.

15.Privacy

R26 Studio Inc. collects personal information (names, email addresses, phone numbers, property addresses, and payment information) for the purpose of confirming bookings, delivering services, and communicating with clients. This information is not sold, rented, or shared with third parties except as required to deliver services or as required by law.

R26 Studio Inc. complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy legislation. Clients may request access to or correction of their personal information by contacting hello@r26.ca.

16.Governing Law — Province of Ontario

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. The parties irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario. The UN Convention on Contracts for the International Sale of Goods does not apply.

17.Dispute Resolution

In the event of any dispute, the parties agree to first attempt resolution through good-faith negotiation by contacting hello@r26.ca. If a resolution cannot be reached within 30 calendar days, either party may pursue resolution through the appropriate courts in Ontario.

For disputes within the jurisdiction of the Ontario Small Claims Court, either party may file a claim in that court without prior arbitration. Nothing in this section prevents R26 Studio Inc. from seeking injunctive relief to protect its intellectual property.

18.Changes to These Terms

R26 Studio Inc. reserves the right to update these Terms at any time. Changes are effective immediately upon posting at r26.ca, with the “Last Updated” date reflecting the most recent revision. For existing clients with active bookings, material changes will be communicated by email. Continued use of the website after changes constitutes acceptance.

R26 Studio Inc. will make reasonable efforts to respond to all inquiries within 2 business days.

20.Effective Date

These Terms and Conditions are effective as of April 13, 2026 and supersede all prior versions of R26 Studio Inc.'s terms of service, policies, and agreements.
